Through our rigorous tenant screening process, we maintain a long-term 99% on-time rent payment rate. However, unexpected situations can still occur. Evicting tenants who fail to pay rent is a sensitive and complex matter, and property management companies must strictly follow local laws and regulations while adhering to the proper procedures.
When a tenant fails to pay rent on time, we first send a late payment notice, reminding the tenant to pay the overdue rent and including applicable late fees and penalty clauses. We also communicate with the tenant to understand the reason for the delayed payment and attempt to reach a resolution, such as establishing a payment plan. If the tenant continues to withhold payment, we send an official lawyer's letter, warning that they must pay the overdue rent within a specified period, or we will take further action.
If the tenant still does not take corrective action, the property management company will, through a lawyer, formally initiate the eviction process, which includes filing a complaint with the court and awaiting the court's hearing and ruling. Once the court rules in favor of the eviction, we request a court order for enforcement, typically carried out by law enforcement to remove the tenant from the rental property.
It is important to note that property management companies must comply with local rental laws and regulations during the eviction process and ensure that tenants' rights are respected. At all times, issues should be handled in a legal, fair, and transparent manner to avoid infringing on the tenant's rights while protecting the landlord's interests.
